All Assault Charges and AVO dismissed in Court - Police then Withdraw Contravene AVO case
Through effective cross-examination, Sydney Criminal Lawyers had all assault charges and the AVO dismissed in Newtown Local Court for our 23 year old Earlwood client.
Police realised that the complainant would be discredited in any future proceedings, and then withdrew an additional case of Contravene AVO that they brought against our client.
That case had been expected to proceed to a defended hearing.
Best Defence in Local Court Assault and AVO Hearings
Over the past two-weeks, Sydney Criminal Lawyers won all 7 of its Assault and AVO cases in various Local Courts.
Some cases involved charges of Assault Police, Assault Occasioning Actual Bodily Harm and Stalk / Intimidate.
They were successfully defended by our team in Downing Centre Court, Burwood Court, Parramatta Court and Waverley Court.
High Range PCA and DUI Charges Dropped
Police were forced to withdraw drink driving charges against our 48 year old client from Castle Hill after they failed to follow the law.
The case involved our client crashing into a telegraph pole while allegedly driving with a blood alcohol concentration of 0.197.
He was breath tested and charged with High Range PCA.
He was advised by his first lawyers to plead guilty to the charge but sought a second opinion from Sydney Criminal Lawyers.
We obtained material by subpoena which proved that he was breath tested after the 2 hour limit.
Police then tried to fix their mistake by adding the charge of Driving Under the Influence ('DUI').
However, police were forced to drop both charges when Sydney Criminal Lawyers made written submissions that the law does not permit a driver to be charged with DUI after being breath tested.
Our client acknowledges that he was extremely fortunate not to have injured or even killed other road users.
He vows to never drink and drive again.
Suspended Sentence for Ongoing Drug Supply and Participate in Criminal Group
Sydney Criminal Lawyers obtained 'Suspended Sentences' (no prison) in Downing Centre District Court for our 22 year old client for 'Supply Drug on Ongoing Basis', 11 charges of 'Supply Prohibited Drug' and 'Participate in Criminal Group'.
The case involved the supply of approximately 60 ounces of heroin and cocaine over several months.
Our Ugur Nedim persuasively presented the case before the District Court Judge who ultimately found exceptional circumstances in our client's favour and refrained from sending him to prison.
All involved had expected a lengthy prison sentence.
It is an incredible result considering that our client has several previous criminal convictions, and the official sentencing statistics for similar offenders say that 100% were sent to prison.
Jury finds man 'not guilty' of Sexual Assault
A jury in Parramatta District Court unanimously found our 38 year old client 'not guilty' of all 3 counts of 'sexual intercourse without consent'.
The case involved our client and the female complainant meeting in a Sydney Cabaret Bar and sharing drinks.
The complainant then invited our client back to her sister's apartment.
The pair were engaging in sexual intercourse on the balcony, when the sister came out of her bedroom and said 'What are you doing? You have a boyfriend'.
The complainant then claimed she was being sexually assaulted.
It is unfortunate that police and the over-zealous DPP insisted on the case going all the way to a jury trial.
